By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
We may modify these Terms at any time. Updated Terms will be effective when posted, and your continued use of the Site after posting constitutes acceptance of the revised Terms. You should review these Terms periodically.
The Site is intended for users who are at least 18 years of age and located within the United States and its territories. By using the Site, you represent that you meet these requirements.
The Site is provided for general informational and marketing purposes only. Content on the Site is not medical advice, diagnosis, or treatment and should not be relied upon as a substitute for consultation with qualified healthcare professionals.
Use of the Site does not create a provider-patient, physician-patient, or healthcare provider relationship between you and Switchboard or any of its affiliates, employees, contractors, or partners. Switchboard is not a healthcare provider and does not deliver medical care through the Site.
If you have or may have a medical emergency, call 911 or contact emergency services immediately. If you have questions about your health, consult a licensed healthcare provider.
The Site is not a platform for the submission, transmission, or storage of "protected health information" ("PHI") as defined under the Health Insurance Portability and Accountability Act ("HIPAA"). Do not submit PHI through any form, email, or other communication channel on the Site.
Switchboard's handling of PHI through its separate platform and services is governed by applicable Business Associate Agreements, Notices of Privacy Practices, and other agreements with our covered entity customers — not by these Terms.
All content on the Site — including text, graphics, logos, images, software, designs, and trademarks (collectively, "Site Content") — is owned by Switchboard or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site Content for personal, non-commercial purposes. You may not:
"Switchboard Health," the Switchboard Health logo, and any related names or logos are trademarks of Switchboard Health, Inc. Use of these marks without our written permission is prohibited.
You agree not to use the Site in any way that:
We reserve the right to investigate and take appropriate action — including blocking access, removing content, or reporting violations to law enforcement — against any user who violates these Terms.
Information you submit through forms on the Site (e.g., demo requests, contact inquiries) is governed by our Privacy Policy. By submitting any content, you represent that:
You grant Switchboard a worldwide, royalty-free, non-exclusive license to use submitted information for purposes of responding to your inquiry, improving our Services, and as otherwise described in our Privacy Policy.
The Site may contain links to third-party websites, services, or resources. Switchboard does not control these third parties and is not responsible for their content, accuracy, privacy practices, or policies. Your use of third-party websites is at your own risk and subject to their terms.
References to third-party products, services, or organizations on the Site are for informational purposes only and do not constitute endorsement.
THE SITE AND ALL SITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SWITCHBOARD DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION:
You acknowledge that any reliance on Site Content is at your own risk.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SWITCHBOARD, ITS AFFILIATES, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF SWITCHBOARD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ANY EVENT, SWITCHBOARD'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Switchboard, its affiliates, and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
You and Switchboard agree that any dispute will be resolved on an individual basis. You waive any right to participate in a class action, class arbitration, or representative action.
We may suspend or terminate your access to the Site at any time, without notice, for any reason — including violation of these Terms. Upon termination, the provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Switchboard regarding your use of the Site and supersede all prior agreements.
